On November 10, 1969, after a trial to the court without a jury, the plaintiff in error, Peter J. Hawpetoss (hereinafter defendant), was found guilty of theft from the person (sec. 943.20 (1) (a) and (3) (d) 2, Stats.), and of operating a motor vehicle without the owners consent (sec. 943.23). He was sentenced to not more than four years in the state prison on each count, with the sentences to run consecutively.
