APPEAL AND ERROR ? JUDGMENTS. 1. Judgment ? Effect of appellate courts judgments. Appellate courts judgments are as conclusive as those of any other court, they not only establish facts, but also settle law, so that law as decided on any appeal, must be applied in all subsequent stages of same cause, and they are res judicata in other cases as to every matter adjudicated. 2. Judgment ? Supreme Courts judgment cannot be challenged in another action. After Supreme Courts dismissal of appeal from district courts judgment denying petition for writ of mandate, such judgment could not again be challenged by another action in district court to vacate and set aside judgment, in absence of fraud, perjury, or other collusive action.
